Agreement Overview

These Terms of Use ("Terms") govern your use of the Gene2Rx website (the "Website"), the Gene2Rx iOS mobile application (the "App"), and all associated software and services (collectively, the "Service"). Your use of any part of the Service constitutes your acceptance and understanding of the following terms, conditions and guidelines.

By accessing or using the Service, including downloading or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Service.

Mobile Application

The Gene2Rx App is a companion application to the Website that allows you to view your pharmacogenetic results, track medications, log symptoms and moods, and optionally integrate with Apple HealthKit. The following additional terms apply to your use of the App:

1. License. We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal iOS device for your personal, non-commercial use in accordance with these Terms.
2. Account required. The App requires a Gene2Rx account. You must first create an account and purchase a report through the Website or a supported partner before accessing your results in the App.
3. On-device data. Certain data you enter in the App (including medications, symptoms, mood entries, and dose tracking) is stored exclusively on your device and is not transmitted to our servers. You are responsible for maintaining backups of your device. Uninstalling the App will permanently delete all locally stored data.
4. App Store terms. Your use of the App is also subject to Apple's standard Terms of Service for App Store products. In the event of any conflict between these Terms and Apple's terms, these Terms shall govern your relationship with Gene2Rx.
5. Updates. We may release updates to the App from time to time. While we recommend installing updates promptly, we do not guarantee backward compatibility with older versions of the App.

Subscriptions & In-App Purchases

The App may offer optional subscription plans and in-app purchases ("Pro" features) processed through Apple's App Store. The following terms apply:

1. Billing. All in-app purchases and subscriptions are processed by Apple. Gene2Rx does not collect or store your payment information for App purchases. All billing inquiries for App purchases should be directed to Apple.
2. Subscription renewal. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage or cancel your subscription through the App Store settings on your device.
3. Free and paid features. Certain features of the App are available for free, while others require an active subscription. We reserve the right to change which features are included in free and paid tiers.
4. No refunds from Gene2Rx. Since App subscriptions are processed by Apple, refund requests for in-app purchases must be submitted to Apple in accordance with their refund policies.

Apple HealthKit

The App may optionally integrate with Apple HealthKit to read health data such as heart rate, blood pressure, body weight, blood glucose, step count, and sleep analysis. By granting HealthKit access, you agree to the following:

1. HealthKit data is used solely to display health metrics alongside your pharmacogenetic information within the App.
2. HealthKit data is stored only on your device and is never transmitted to Gene2Rx servers or any third party.
3. HealthKit data is never used for advertising, marketing, data mining, or any purpose other than displaying it to you within the App.
4. You may revoke HealthKit access at any time through the iOS Settings app, and the App will continue to function without it.

Privacy Statement

Through the use of the Service, certain information may be collected that is personal in nature. We recognize and respect the need to take care when handling your personal information. Your genetic data is encrypted on our servers to protect your privacy. However, while we take security seriously there are no guarantees a data breach will not occur.

On the Website, we do log IP addresses, login times, operating systems and browser software. We analyze this data in aggregate to determine traffic patterns and optimize web page design. This data does not contain your name or your email address. We may provide this anonymized log data to third parties such as advertisers, potential licensors, and other business associates. The App does not use third-party analytics or tracking services.

Cookie Disclosure Statement

"Cookies" are files transferred back and forth between the server and your browser. Cookies can be used to keep track of the number of times you've visited a specific web page and enhance user experience. We do not log cookies for tracking purposes.

Essential cookies may be used to maintain your session and ensure proper functionality of our services. You can control cookie settings through your browser preferences.

Third Party Links & Services

In order to provide you with additional information about our services, we may link to other websites or integrate with third-party services. Gene2Rx is not responsible for the privacy practices or the content of other websites or services. We encourage you to review the privacy policies of any external sites you visit.

The App may access publicly available data from the U.S. Food and Drug Administration (FDA) to provide drug label and dosage information. The App also uses Apple's StoreKit for in-app purchases and may integrate with Apple HealthKit with your permission. These third-party services are subject to their own terms and privacy policies.

User Obligations

You may not:

• Create user accounts under false or fraudulent pretenses
• Impersonate another person or entity
• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service
• Reverse engineer, decompile, or disassemble the App or any part of the Service
• Redistribute, sublicense, or make the App available to third parties

You agree to:

• Keep your password confidential and secure
• Allow us to keep de-identified summary statistics for performance improvement and system monitoring
• Consult with your healthcare provider before making any medication adjustments based on our information
• Provide accurate information when using our services
• Use our services responsibly and in accordance with applicable laws

Refund Policy

We do not issue refunds based on customer requests once reports have been generated and made available. We provide example reports so that users are aware of what genes, guidance, and medications will be included in the report they receive.

As a user of the Service, you understand that your results may differ from the example reports due to report results being calculated based on the genetic data you provide. We encourage you to review our example reports before purchasing to ensure our service meets your expectations.

For purchases made through the App via Apple's App Store, refund requests must be submitted directly to Apple. Gene2Rx does not have the ability to process refunds for App Store transactions.

Liability & Warranties

Visitors and customers will assume all risk for using the Service, including but not limited to, unsupported or unreplicated research or medical data and information, and/or any other foreseen or unforeseen possibility.

Users who access the Service agree to indemnify and hold harmless GENOME ANALYTICS L.L.C. and other related entities, including our programmers and editors, for any and all damages arising from the use of the Service, including the Website, the App, and related software.

There are no warranties expressed or implied as to the results obtained from the use of the information contained on the Website, in the App, or in any reports generated through the Service. Users use this information and related software at their own risk.
